These Terms of Service ("Terms") govern your use of the website, communication services, estimates, scheduling tools, and tree or property services offered by Gordon's Tree Service ("Gordon's Tree Service," "we," "our," or "us").

By requesting an estimate, approving a quote, scheduling services, communicating with us, using our website, or allowing us to begin work, you acknowledge that you have read and agree to these Terms.

2. Services

Gordon's Tree Service may provide services including:

  • Storm-damage cleanup
  • Brush and debris removal

  • Tree, limb, or property-condition assessments
  • Other outdoor property services described in an approved estimate or service agreement

The specific scope, price, and conditions of each job will be stated in the applicable estimate, quote, work order, invoice, or written agreement.

Services not expressly included in an approved estimate are considered additional work and may result in additional charges.

3. Estimates and Quotes

Estimates are based on the property conditions and information available at the time of inspection or request.

Unless otherwise stated in writing:

  • Estimates are valid for [30] days.
  • Estimates may be revised if site conditions change.
  • Estimates may be revised if previously hidden or undisclosed conditions are discovered.
  • Additional work requested by the customer will be billed separately.
  • An estimate does not reserve a service date until scheduling is confirmed.
  • Verbal estimates are preliminary and may be replaced by a written estimate.

Pricing may change when the work involves unexpected hazards, inaccessible areas, concealed damage, utility conflicts, unstable trees, underground obstacles, protected vegetation, additional debris, or work that differs materially from the conditions originally described.

4. Customer Authorization

The person approving work represents that they:

  • Own the property;
  • Have permission from the property owner to authorize the work; or
  • Are otherwise legally authorized to contract for services at the property.

The customer is responsible for identifying property boundaries and confirming that trees, limbs, or vegetation included in the work are located on the customer's property or may legally be serviced.

Gordon's Tree Service may request proof of ownership or written authorization before beginning work.

The customer agrees to be responsible for disputes involving ownership, property lines, neighboring property, homeowners' associations, or unauthorized tree removal when Gordon's Tree Service reasonably relied upon the customer's authorization.

5. Scheduling

Service dates and arrival windows are estimates rather than guarantees unless expressly stated otherwise in writing.

Scheduling may be affected by:

  • Weather
  • Ground conditions
  • Equipment availability
  • Crew safety
  • Emergency or storm-response work
  • Utility conditions
  • Road access
  • Permit requirements
  • Unforeseen job-site hazards
  • Delays at an earlier job

We will make reasonable efforts to communicate significant scheduling changes.

6. Weather and Unsafe Conditions

Tree work can be hazardous during rain, lightning, high winds, extreme heat, saturated soil, ice, or other unsafe conditions.

Gordon's Tree Service may postpone, suspend, or reschedule work when we determine that conditions could endanger workers, customers, property, equipment, or the public.

A weather-related delay does not constitute a breach of these Terms.

7. Property Access

The customer agrees to provide reasonable and safe access to the service area on the scheduled date.

Before work begins, the customer should:

  • Unlock gates
  • Move vehicles, trailers, toys, furniture, decorations, or equipment from the work area
  • Secure pets and livestock
  • Notify household members or tenants
  • Identify septic systems, irrigation systems, invisible fences, wells, drainage systems, landscape lighting, or other underground or concealed property features
  • Identify fragile landscaping, structures, fences, or personal property near the work area
  • Inform us of known hazards

Additional charges may apply if crews are delayed or unable to work because access was not provided.

8. Underground and Concealed Conditions

The customer is responsible for identifying privately installed or concealed items that may not be located through a public utility-marking service, including:

  • Irrigation systems
  • Invisible pet fences
  • Private electrical wiring
  • Septic systems
  • Drainage lines
  • Landscape lighting
  • Private water lines
  • Underground propane or fuel lines
  • Unmarked cables or piping

Gordon's Tree Service is not responsible for damage to underground or concealed items that were not marked, disclosed, or reasonably visible before work began, except where the damage results from our failure to exercise reasonable care.

9. Utilities

The customer must inform Gordon's Tree Service of known utility lines or utility-related concerns near the work area.

Work near electrical, telephone, cable, gas, water, or other utility infrastructure may require coordination with the appropriate utility provider.

We may delay or decline work until necessary utility precautions, authorizations, or shutdowns have been completed.

10. Permits, Approvals, and Restrictions

Unless an estimate expressly states otherwise, the customer is responsible for obtaining and paying for permits, homeowners' association approvals, neighborhood approvals, or other authorizations required for the requested work.

Gordon's Tree Service may assist with determining whether an approval appears necessary, but the customer remains responsible for confirming applicable property restrictions.

Any fines, penalties, replacement requirements, or disputes resulting from undisclosed restrictions or a customer's failure to obtain approval are the customer's responsibility.

11. Tree Health and Condition

Trees are living organisms, and their internal condition cannot always be determined through an ordinary visual inspection.
Decay, disease, cavities, root damage, structural weakness, insects, storm damage, or other defects may be concealed.

Unless expressly included in writing, our services do not constitute:

  • A formal arborist report
  • A structural engineering opinion
  • A guarantee that a tree is safe
  • A guarantee that a remaining tree or limb will not fail
  • A guarantee regarding future tree health, growth, or survival

Recommendations are based on the conditions reasonably observable at the time of service.

12. Debris and Cleanup

Debris removal will be performed only as described in the approved estimate.
The estimate should state whether the price includes:

  • Hauling logs
  • Hauling brush
  • Removing wood chips
  • Raking the immediate work area
  • Cutting wood into firewood lengths
  • Leaving logs or mulch at the property
  • Stump grinding
  • Removal of stump grindings

Tree work may leave small twigs, leaves, sawdust, wood chips, impressions in soil, or minor disturbance in the immediate work area.

Unless otherwise stated, firewood-sized logs are not split, stacked, seasoned, or moved to a separate location.

13. Lawn and Landscape Conditions

Tree-service equipment may leave tire marks, depressions, disturbed soil, or damage to grass and landscaping, particularly when the ground is wet, soft, sloped, or difficult to access.

We will use reasonable care to reduce unnecessary damage. However, ordinary access-related disturbance may be unavoidable when completing authorized work.
The customer should identify any landscaping or property feature requiring special protection before work begins.

Special protective measures may involve additional charges.

14. Stump Grinding

When stump grinding is included, grinding depth and area will be stated in the estimate when practicable.

Unless specifically included:

  • Surface roots extending away from the stump may not be removed.
  • Underground roots will remain.
  • Stump grindings may remain at the property.
  • Soil restoration, grass seed, sod, or replanting is not included.
  • Gordon's Tree Service does not guarantee that new growth, sprouts, fungi, or settling will not occur.

The customer must disclose underground utilities and concealed property features before stump grinding begins.

15. Changes to the Work

Any change to the original scope of work should be approved by the customer.
Approval may be documented through:

  • A revised estimate
  • A written change order
  • Email
  • Text message
  • Electronic approval through Jobber
  • Another written communication

Additional work may result in additional labor, equipment, disposal, material, or scheduling charges.

16. Deposits

A deposit of [deposit amount or percentage] may be required before work is scheduled or equipment is reserved.
Unless otherwise stated in writing, deposits will be applied toward the final invoice.
Deposit refund eligibility will depend on:

  • The timing of the cancellation
  • Equipment or subcontractor commitments
  • Permit expenses
  • Materials purchased
  • Work already completed
  • Other documented costs incurred for the job

Any job-specific deposit terms stated in an estimate or agreement will control if they differ from this section.

17. Cancellations and Rescheduling

Customers should provide at least [24/48] hours' notice to cancel or reschedule a non-emergency appointment.

A cancellation or rescheduling charge of [amount or policy] may apply when:

  • Notice is not provided within the required time;
  • A crew or equipment has already been dispatched;
  • Special equipment has been reserved;
  • A subcontractor has been scheduled; or
  • The property cannot be accessed when the crew arrives.

No cancellation fee will apply when Gordon's Tree Service postpones work because of weather or unsafe conditions.

18. Payment Terms

Payment terms will be stated on the applicable estimate or invoice.
Unless otherwise agreed in writing:

  • Payment is due upon completion of the work.
  • The customer must promptly notify us of any invoice question.
  • The customer may not withhold undisputed amounts because of a dispute concerning another portion of the work.
  • Returned payments may be subject to a fee of [amount].
  • Past-due balances may incur a late charge of [amount or percentage], to the extent permitted by law.
  • The customer is responsible for reasonable collection costs permitted by law.

Electronic payments may be processed by Jobber or another third-party payment provider and may be subject to that provider's terms.

19. Workmanship Concerns

Customers should inspect the completed work and notify Gordon's Tree Service of any concern as soon as reasonably possible.

Workmanship concerns should be reported within [seven] days after completion unless a different period is stated in writing.

We must be given a reasonable opportunity to inspect and, where appropriate, correct work before the customer hires another provider to make changes.
This provision does not limit any rights that cannot legally be waived.

20. Limited Warranty

Gordon's Tree Service warrants that services will be performed in a professional manner consistent with generally accepted practices for the type of work requested.
Unless expressly stated in writing, we do not guarantee:

  • The future health or survival of a tree, plant, lawn, or landscape
  • The prevention of future limb or tree failure
  • The elimination of insects, disease, decay, or fungal growth
  • The future growth of roots or sprouts
  • A particular cosmetic result
  • The prevention of storm-related damage
  • Conditions controlled by weather, soil, disease, wildlife, utilities, or third parties

Any specific warranty included in an estimate or written agreement will control over this general section.

21. Customer Property and Personal Items

The customer is responsible for removing or protecting personal property from the work area.

Gordon's Tree Service is not responsible for damage to movable property left within an active work zone after the customer was informed or reasonably should have understood that the area needed to be cleared.

This does not excuse damage caused by our failure to use reasonable care.

22. Limitation of Liability

To the fullest extent permitted by law, Gordon's Tree Service will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the services, including lost profits, lost use, or loss of business opportunity.

Our responsibility for a direct claim will be limited to the amount paid for the specific service giving rise to the claim, except where a different remedy is required by law or where the loss results from conduct for which liability cannot legally be limited.

Nothing in these Terms excludes rights or remedies that cannot be excluded under applicable law.

23. Photos and Documentation

Gordon's Tree Service may photograph or record the property, trees, damage, access conditions, work progress, and completed services for:

  • Job documentation
  • Safety records
  • Estimate preparation
  • Insurance purposes
  • Customer communication
  • Dispute resolution
  • Internal training

We will not use photographs that clearly identify the customer, street address, license plates, house numbers, or other identifying information for public advertising without permission, except where the identifying information has been reasonably removed or obscured.

Customers may request that photographs not be used for public marketing.

24. Website Use

You may use our website only for lawful purposes.

You may not:

  • Attempt to interfere with website security or operation
  • Submit false or misleading service requests
  • Impersonate another person
  • Use the website to transmit unlawful, harmful, or malicious content
  • Copy or exploit website content in violation of applicable intellectual-property laws

Website content is provided for general information and may be changed without notice.

25. Text Messaging Terms

By providing your mobile telephone number and consenting to receive text messages, you agree that Gordon's Tree Service may send you text messages regarding:

  • Estimate requests
  • Appointment confirmations
  • Appointment reminders
  • Scheduling and rescheduling
  • Crew arrival notifications
  • Weather delays
  • Job-status updates
  • Questions about the service property
  • Quotes and approvals
  • Invoices, receipts, and payment reminders
  • Customer-support communications
  • Occasional service announcements or promotional messages, when separately authorized

Message frequency varies based on your service activity and communications with us.

Message and data rates may apply.

Consent to receive text messages is not a condition of purchasing services.
To stop receiving text messages, reply STOP. You may receive one final message confirming that you have been unsubscribed.

Mobile carriers are not liable for delayed or undelivered messages.

Text message delivery is subject to your wireless carrier's network availability and is not guaranteed.

26. SMS Consent and Privacy

Text-message consent applies only to communications from Gordon's Tree Service.

We do not sell, rent, or share mobile telephone numbers, SMS consent information, or text-message opt-in records with third parties or affiliates for their independent marketing or promotional purposes.

Information may be provided to service providers that help us operate our scheduling, customer-management, payment, and text-messaging systems. Those providers may use the information only to provide services on our behalf.

27. Third-Party Services

We use Jobber and may use other service providers for scheduling, customer records, communications, estimates, invoices, and payment processing.

Your use of a third-party platform may also be governed by that provider's terms and privacy practices.

Gordon's Tree Service is not responsible for service interruptions, errors, or security incidents caused solely by an independent third-party platform beyond our reasonable control.

28. Emergencies

Submitting a website form, email, or text message does not guarantee immediate monitoring or emergency response.

For hazards involving electrical lines, fire, gas, public roads, or immediate danger to people or property, contact the appropriate emergency service or utility provider.

Do not approach fallen trees or limbs that may be touching electrical lines.

29. Right to Refuse or Stop Work

Gordon's Tree Service may decline, postpone, suspend, or stop work when:

  • Conditions are unsafe
  • The requested work appears unlawful
  • Property ownership or authorization is disputed
  • Utilities create an unacceptable risk
  • Animals, people, or obstructions prevent safe access
  • The customer requests work outside the agreed scope without approving additional charges
  • The customer or another person engages in threatening, abusive, discriminatory, or dangerous conduct
  • Payment obligations are not met
  • Previously undisclosed conditions materially change the work

The customer remains responsible for authorized work already completed and reasonable costs already incurred.

30. Indemnification

To the extent permitted by law, the customer agrees to be responsible for claims, losses, or expenses resulting from:

  • False statements concerning property ownership or authority
  • Incorrectly identified property lines
  • Undisclosed underground or concealed property features
  • Failure to obtain required permissions
  • Instructions that cause work to be performed on property belonging to another person

This provision does not require the customer to compensate Gordon's Tree Service for losses caused by our own negligence or unlawful conduct.

31. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
Any legal proceeding relating to these Terms or our services will be brought in a court with appropriate jurisdiction in Georgia, unless applicable law requires otherwise.

32. Severability

If any portion of these Terms is found unenforceable, the remaining portions will continue in effect.

The unenforceable provision will be interpreted or modified only to the minimum extent necessary to make it enforceable, where permitted by law.

33. No Waiver

A delay or failure by Gordon's Tree Service to enforce a provision of these Terms does not waive our right to enforce that provision later.

34. Entire Agreement

These Terms, the approved estimate, written change orders, invoice terms, and Privacy Policy constitute the agreement between the customer and Gordon's Tree Service concerning the applicable services.

If a job-specific written agreement conflicts with these general Terms, the job-specific written agreement will control for that job.

35. Changes to These Terms

We may update these Terms periodically.

Revised Terms will be posted publicly with an updated "Last Updated" date. Changes will apply prospectively unless otherwise permitted or required by law.

Terms included in an already approved written estimate will continue to apply to that job unless both parties agree to a change.
